Prices
All prices are quoted net FOB Somerville, MA. All prices are shown in U.S. currency. Prices are subject to change at any time without prior notice. You will be notified of any price change at time of order. Prices do not include shipping and handling unless specifically noted.

Payment
Acceptable forms of payment are limited to:

    • Prepaid cash
    • Personal check (under the conditions listed below)
    • Certified Bank or Cashier's Check
    • Credit Card (VISA, M/C, AMEX)
    • Paypal (eChecks will be held until cleared and buyer pays added fee's)

Personal checks will be accepted as payment only after the funds have cleared and been transferred into Motion Motorsport's account. All merchandise remains the property of Motion Motorsport until payment is finalized. Deposits may be required for special order items.

Shipping
All items will be shipped UPS Ground unless prohibited by size or weight, in which case a motor freight carrier will be used. Expedited shipping may be available at additional cost upon request. For International orders, we may elect to ship by DHL/Airborne Express at our discretion. The actual shipping charges will appear on the e-mail confirmation and on the invoice you receive with your order.

Returns
Motion Motorsport will not accept unauthorized returns. If you need to return an item, please contact by phone only prior to the return. With the exception of returns caused by our error, shipping costs for returned items will be the buyer's responsibility. No return will be accepted without invoice number or date of sale. To receive a refund or credit, returned items must be in original packaging, unused, in original condition and received by Motion Motorsport within 30 days of your original receipt of the product. No credit will be issued for damaged, installed or deformed items. Items will be inspected prior to issuance of any refund or credit. Special order items and electrical parts cannot be returned unless they are defective. All returned items are subject to a 20% restocking charge unless return was caused by our error.

Damaged Items
Motion Motorsport and its suppliers deliver merchandise to carriers properly protected and packaged. Therefore, damage in transit is the responsibility of the carrier. If a package appears damaged when you receive it, indicate the condition of the package (i.e., specific damage) on your receipt from the carrier along with your signature. If damage is discovered after opening the package, notify the carrier immediately. Claims for damage must be handled through the carrier, not Motion Motorsport. If necessary, we will assist you in any claim to the degree practical.

Guarantee
Unless otherwise noted, all Motion Motorsport products are guaranteed to be first quality merchandise. Many products carry a manufacturer's warranty. Motion Motorsport will pass this warranty on to original buyer. Parts purchased used or through unauthorized distribution channels will no longer carry a warranty whatsoever. There is no warranty, expressed or implied, on any parts used for competition or track events. Additionally, there is no warranty on electrical parts. Buyer shall notify Motion Motorsport immediately upon discovery of any product defect. Defective items must be returned for replacement in accordance with our return policy and at buyer's expense. We will replace all defective items that meet return/replacement requirements, but will not accept any liability for loss or inconvenience caused by their use or failure. All warranties are voided if defect has been caused in whole or in part by improper installation, abuse or misuse. We reserve the right to withhold issuance of credit until returned defective part has been examined and tested.

Parts Warranty
Motion Motorsport products carry a non-transferable 6 month warranty against defects from time of purchase. This means parts purchased used or through unauthorized Motion Motorsport retailers (including parts purchase from online auctions such as eBay) carry NO warranty whatsoever, regardless of condition. Parts used in competition, racing, or abuse during this time period are not covered. The warranty does exclude the following:

    • Return shipping charges
    • Towing charges
    • Resulting labor charges
    • Damage to a component or assembly due to installation other than engineered application of product
    • Damage from use of other manufacturer's products in conjunction with Motion Motorsport products
    • Friction materials of any kind
    • Damage attributable to negligence, improper installation, improper treatment or treatment contrary to the instructions in the ownerÕs manual from the original vehicle manufacturer or Motion Motorsport product instructions
    • Any vehicle operated in any competitive event
    • Custom-designed competition parts
    • Incidental and/or consequential damages, including loss of time, inconvenience or loss of the use of the vehicle
    • Damage resulting from environmental influences, flood, accident, fire damage, or road salt corrosion.

Product Use
Many products sold by Motion Motorsport may not be DOT or TUV approved for highway use on public roads. These products are designed for show, off-road or racing applications only. It is the sole and complete responsibility of the buyer to ensure that their vehicles meet all federal, state and local laws and regulations. Buyer assumes all liability and risk associated with the use of high performance products and holds Motion Motorsport and its owners harmless of any liability.

Merchandise: We sell new parts for BMW automobiles; please note that product descriptions and photographs used on our online catalog are examples only. Actual item may differ.

The Customer shall inspect and accept or reject acceptance of the Terms and Conditions of this sale immediately upon the arrival of the shipment, and shall, within three (3) working days after this arrival, give written notice to Motion Motorsport of any claim that the Terms and Conditions set forth herein are not acceptable. The Customer expressly waives any right the Customer may have to revoke acceptance after such three-day period.

Fraudulent Orders: We will seek to prosecute any and all fraudulent transactions. We use all means necessary to convict including recording of IP addresses. All fraudulent orders will be filed with the IFCC (Internet Fraud Complaint Center). The Internet Fraud Complaint Center (IFCC) is a partnership between the Federal Bureau of Investigation (FBI) and the National White Collar Crime Center (NW3C). http://www1.ifccfbi.gov

Applicability: These Terms and Conditions are applicable to all orders placed by the customer, whether online on the Motion Motorsport web site or by telephone, including all future orders.
